TERMS OF COACH

TemuCoach is a platform that connects clients with professional aerobic and anaerobic exercise instructors. The term 'client' refers to an individual seeking coaching services, while 'coach' refers to the individual providing these services.

By registering as a coach on TemuCoach, all coaches must read, understand, and agree to the Terms and Conditions outlined in this policy.

1. Coach Qualification

A coach must be at least 21 years old and possess relevant certification, accreditation, or professional experience in their respective coaching field.

2. Coach Validation

Coaches are responsible for ensuring that all information provided to TemuCoach is accurate and truthful. Any submission of false or misleading information may result in the following actions:

(a) Blacklisting from TemuCoach’s database.
(b) Disclosure of the coach’s contact details to partner agencies.
(c) Legal action, if necessary.

Clients have the right to verify a coach’s credentials and request documentation as proof before engaging in coaching sessions.

3. Assigning and Accepting Clients

TemuCoach does not guarantee that coaches will be selected for coaching job offers, even after submitting applications. Only shortlisted candidates will be contacted.

Before accepting a coaching job offer, coaches must ensure that they can fully commit to the agreed-upon terms, including session schedules, fees, and any specific requirements.

4. Conduct of Coaches

TemuCoach reserves the right to suspend or terminate a coach’s account due to repeated poor conduct. Guidelines for proper conduct include, but are not limited to:

(a) Coaches must be punctual for all coaching sessions.
(b) If a coach cannot attend a session, they must inform the client at the earliest opportunity.
(c) Coaches must maintain professionalism and refrain from verbal or physical misconduct.
(d) Coaches must dress appropriately for sessions, whether in person or virtual.
(e) Coaches should provide constructive feedback and support for client development.

5. Payment of Service Charge

TemuCoach charges a one-time service fee, calculated as 50% of the agreed coaching fee for four (4) weeks, based on the final hourly rate agreed upon by both the coach and client at the time of accepting the coaching job offer.

Coaches are required to pay the service fee within twelve (12) hours of accepting a coaching job offer. Failure to do so may result in the cancellation of the job offer, and the opportunity will be offered to another coach.

6. Termination of Job Offer

6.1 Termination by Coach

If a coach terminates a job offer for any reason, the service fee will not be refunded.

6.2 Termination by Client

If a client terminates a job offer, the refund policy for the service fee is as follows:

(a) Termination before the first session: Full refund of the service fee to the coach.
(b) Termination after the first session: 75% refund of the service fee to the coach.
(c) Termination after the second session: 50% refund of the service fee to the coach.
(d) Termination after the third session: 25% refund of the service fee to the coach.
(e) Termination on or after the fourth session: No refund of the service fee.

Refunds will be processed within 24 hours upon verification. Coaches must provide session details for verification purposes.

7. Default of Payment by Client

If a client delays payment, TemuCoach will assist the coach in recovering the payment. However,
TemuCoach is not legally responsible for payment disputes between the coach and client and will not be liable for unpaid coaching fees.

8. Age, Gender, and Race Preference

To improve the accuracy of coach-client matching, TemuCoach may include age, gender, or race preferences in the job offer description. Coaches may opt out of receiving such information if they are uncomfortable with it.

9. Disclaimer

TemuCoach acts solely as an intermediary in the matching process. TemuCoach, its directors, and employees are not liable for any damages or harm (including but not limited to financial loss, misconduct, disputes, or dissatisfaction with services) incurred by either party.

TemuCoach does not guarantee timely payments from clients or the positive attitude of the client.

TemuCoach reserves the right to amend these Terms and Conditions at any time without prior notice to the coaches.
